By joining Berry Fitness 24|7 as a member, you agree to the terms below. Please read them carefully. If you have any questions, speak to a Berry Fitness team member at the club.

General

  • Berry Fitness is a 24-hour fitness facility. By joining as a member, you agree to abide by all rules, terms, and conditions outlined in this agreement.
  • At all times while on Berry Fitness premises, your property and your person are at your own risk. You will not hold Berry Fitness, its directors, employees, contractors, or instructors liable for any personal injury or loss of property, whether caused by negligence or otherwise.
  • You acknowledge that the Berry Fitness facility may be unsupervised at times.
  • You warrant that you are physically and medically fit to undertake a normal course of exercise.
  • If you are under 18 years of age, you must attend the facility with a parent or legal guardian during unstaffed hours.
  • Class timetables and schedules are at the discretion of Berry Fitness management and may be amended at any time without notice.

First 2 Weeks Free Offer

  • On joining, you receive a first 2 weeks free offer, starting on the date of signup.
  • At the end of the first 2 weeks free offer, your membership automatically rolls into the direct debit membership you selected at signup — no further action is required.
  • Direct debit payments commence at the end of the first 2 weeks free offer, in line with the payment frequency (weekly or fortnightly) and start date you selected at signup.
  • If you don’t wish to continue beyond the 2 weeks free offer, you must cancel your membership during the first 2 weeks free period in line with the cancellation terms below.
  • The first 2 weeks free offer is available to new members only and is limited to one trial per person.

Payments, Cancellations & Changes

  • To cancel your membership, 7 days’ written notice is required. Cancellation must be completed by submitting the Berry Fitness cancellation form in person at the facility.
  • All membership instalments are payable whether or not you use Berry Fitness facilities or services, and will continue until further notice.
  • Membership freezes are available for Direct Debit memberships.
  • Time spent on a freeze does not count toward any minimum term.
  • If you wish to downgrade your membership, you must submit a Downgrade Membership Form in person. Downgrades will be actioned 7 days after written notice is received.
  • All memberships are non-refundable.
  • Paid-in-full memberships are non-refundable.
  • Memberships may be transferred to another party, subject to a $25 transfer fee.
  • All Direct Debits are processed on a weekly or fortnightly basis, on dates selected by the member.
  • If your membership account falls more than one week in arrears, access to the facility may be suspended until the account is brought up to date.

Agreement & Release of Liability

  1. In consideration of being permitted to participate in fitness activities and programs and to use the facilities, equipment, and services of Berry Fitness Pty Ltd, you waive, release, and discharge Berry Fitness and its directors, officers, employees, contractors, agents, and representatives from all claims for injury, loss, or damage to person or property — including those arising from negligence — connected with participation in any Berry Fitness activity or use of equipment.
  2. You acknowledge that physical exercise and use of equipment involve inherent risks, including serious injury or death, and you voluntarily assume all such risks.
  3. You agree to the following personal responsibilities while participating in Berry Fitness activities:
    • Completing appropriate warm-up and cool-down activities
    • Inspecting equipment before use
    • Using equipment only as directed
    • Exercising at an intensity suitable for your health and fitness level
    • Wearing appropriate exercise attire and footwear
    • Ceasing activity immediately if experiencing dizziness, nausea, chest pain, or other abnormal symptoms, and notifying staff
    • Informing instructors of changes in medical condition
    • Seeking medical clearance if concerned about participation
    • Not participating while under the influence of alcohol, drugs, or unapproved medication
  4. You declare that you are medically fit to participate in exercise and have obtained appropriate medical clearance where required.
  5. If you choose to participate without medical approval, you accept full responsibility for your participation.
  6. You acknowledge that Berry Fitness providing a program does not constitute medical advice or confirmation of your health status.

Photo & Video Permission

Berry Fitness may take photographs or videos during sessions for marketing and promotional purposes, including use on websites, social media, and in-club displays.

By registering with Berry Fitness, you consent to the use of your image for these purposes without compensation. You may withdraw consent at any time, except where materials have already been produced or published.
